Is Online Betting Legal?
Internet Gambling’s legality can appear for the residents of the United States of America to be a complex issue. For good reason, it is, but there are disagreements regarding what the law says about it. Until those are cleared up, the picture of whether sports online betting is legal or not is always going to be a bit cloudy. To better our understanding of the question of the legality of sports betting in the U.S., Let us look into the Interstate Wire Act of 1961 and at some of the history of anti-gambling legislation.
The United States for a number of years have argued against the legality of internet gambling or online betting through the citation of the Interstate Wire Act. It was passed to prohibit gambling in sports between states through the use of the telephone or any other wire-containing devices. On the invention of the internet, a sum of legal experts questioned if gambling over the internet is part of the scope of the said law.
Other questions arose from the Wire Act and one was that if the law pertained to all forms of gambling or if it was just inclusive to betting on sports events. The 5th U.S. circuit court of appeals in the year 2002 upheld a ruling in the state of Louisiana that dismissed a lawsuit. It was brought by two Internet gamblers against their credit card companies after running up debts by placing bets on casino games. The court’s dismissal had ruled the Wire Act only pertinent to sporting events.
However, The United States Justice Department saw things differently and claimed the wire act was related and should have included all forms of online betting. The Middle District of the U.S. District court in Louisiana had agreed to this claim. The dismissal of the case was made in 2004 against the Justice Department brought by the operator of a website that serves a portal to gambling sites named Casino City. The court stated that “"The government's interest is specifically directed towards the advertising of illegal activity, namely Internet gambling..." The dismissal was then upheld by the 5th Circuit U.S. Court of Appeals.
Going back to the question, is Online Betting Legal? The safest answer to say would be is that it is currently illegal in spite that it is using a pretty generous interpretation of the law. However, no arrest is still made in the United States for merely joining online betting over the internet. It's highly unlikely with the WTO ruling of Dec. 21, 2007 that anything will change in the U.S. in the near future, as there is no longer any incentive to make any type of concessions to the gambling sector.
